Term and Conditions

-The parcel will be sold times 157.98 taxable acres as determined by the Mellette County Assessor.

-Seller reserves the right to confirmation of the sale. Upon confirmation of sale by the seller, the buyer and seller will complete an Offer to Purchase contract and this document will become the binding contract for the completion of the sale.

-Terms of the sale will be cash, 20% down date of sale payable by cash, cashier’s check, or personal/business check accompanied by bank letter of credit and is to be held in escrow with Whalen Law Office Trust account until closing.  The balance will be due upon closing. Possession upon closing. Closing is expected in 30 days or sooner upon provision of merchantable title.

-Title to be transferred by Warranty Deed and Title Insurance spit 50/50 between Seller & Buyer, Preliminary commitment will be available for inspection

-Potential buyers must have proof of financial ability to make payment by sale date or may, at the discretion of the auctioneer, be disqualified from bidding at the sale.
